Should I Stay or Should I Go?
Maybe you saw this article recently that suggests that worst thing a Dad can do in a divorce is leave the family home. Don’t believe it. http:http://www.huffingtonpost.com/joseph-e-cordell/moving-out-after-divorce_b_5510895.html//
Unless you live in a state in which the divorce laws were written in 1820, this is bunk. Arizona has no concept of abandonment in the divorce realm. Leaving to preserve the peace will not affect your ability to have joint legal decision making authority for you kids or shared (50/50) parenting time. It will not affect your property rights. And it will not be the issue that decides who pays the mortgage.
What will negatively affect your parenting time is a domestic violence conviction. So if things are tense, LEAVE!
If things aren’t that tense, see an attorney and work out a separation agreement to smooth the way.
