3 things you never do when you're pulled over after drinking

View All Legal Services »

Maybe you stopped off for a quick brew at your favorite bar or you went out to dinner with friends and had a glass of wine. Whatever the situation, the moment that the police pull you over, you know that you're in trouble. The officer is bound to smell the alcohol on your breath and you know you're about to be accused of drunk driving.

Even if a driving under the influence (DUI) charge seems inevitable, there are a few additional mistakes you could make that would definitely make the situation worse. Here are the things you need to keep in mind:

1. Don't try to speed off.

Some people wait until the police officer exits his patrol car to suddenly gun their engine and speed off. That's a really bad plan. The police already have your license plate number, they're capable of pursuing you for quite a distance and you'll be caught eventually. Then, you'll have additional charges -- like evading arrest -- to deal with on top of the DUI.

2. Don't be disrespectful.

It's frustrating to be pulled over, especially if you think you may be facing a serious ticket -- or worse. However, remain polite toward the officer. There's nothing to be gained from expressing your hostility.

3. Don't start talking.

You have to give the officer your license and your registration, but you don't have to discuss where you've been, where you are going or what you've had to eat or drink that night. Don't decide to be talkative and hope that the officer will be understanding.

Politely decline to answer any questions or discuss anything except the reason you were pulled over. Be respectful but firm.

If you're lucky, the officer will ticket you for the traffic violation that initiated the whole stop. If you do end up charged with a DUI, an experienced criminal defense attorney may be able to help. Contact our office for more information.
